SECTION – 2 – SELLER CODE OF CONDUCT
Aaksha.in enables you to reach millions of customers. We strive to ensure a fair and trustworthy buyer and seller experience. At Aaksha.in, we expect you to adhere to the code of conduct principles outlined below. Violation of the code of conduct principles may result in the loss of your selling privileges and removal from Marketplace.
Seller Code of Conduct Principles:
- Adhere to all applicable laws and abide by all policies.
- Maintain current account information.
- Never misrepresent yourself.
- Always act in a manner that ensures a trustworthy experience for customers.
- Never list products that may cause harm to customers.
- Never engage in any misleading, inappropriate or offensive behaviour. This applies to all your activities, including but not limited to:
- Information provided on your account
- Information provided in listings, content or images
- Communication between you and us or you and our customers
- Act fairly at all times. Unfair behaviour includes but is not limited to the following:
- Behaviour that could be deemed as manipulation or “gaming” of any part of the buying or selling experience
- Actions that could be perceived as manipulating customer reviews, including by directly or indirectly contributing false, misleading or inauthentic content
- Activities that could be perceived as attempting to manipulate Aaksha’s search results or sales rankings
- Actions that intentionally damage another seller, their listings or their ratings
- Only maintain one Seller account for each region in which you sell, unless you have a legitimate business need to open a second account and all of your accounts are in good standing. Examples of a legitimate business justification include:
- You own multiple brands and maintain separate businesses for each
- You manufacture products for two distinct and separate companies
You are recruited for an programme that requires separate accounts
SECTION – 3 – PRODUCT GUIDELINES
The first step towards ensuring a great experience for both buyer and seller is an honest appraisal of the items that you list for sale on Aaksha.in.
- Unacceptable and prohibited items
Items in any of the following conditions are unacceptable for listing:
- Item does not work perfectly in every regard.
- Item is not clean, including signs of mold, heavy staining, or corrosion.
- Item is damaged in a way that renders it difficult to use.
- Item is missing essential accompanying material or parts. This does not necessarily include instructions.
- Item requires repair or service.
- Item was not created by the original manufacturer or copyright holder. This includes copies, counterfeits, replicas, and imitations.
- Item was originally distributed as a promotional copy, promotional bundle, product sample, or advance reading copy. This includes uncorrected proofs of in-print or not-yet-published books.
- Any aspect of the item is obscured and not able to be read or viewed because of markings, stickers, or other damage.
- Item has passed the expiration date (includes “best by” and “sell by” dates), has an unacceptable portion of its shelf life remaining, or has had the expiration date removed or tampered with.
- Item was intended for destruction or disposal or otherwise designated as unsellable by the manufacturer or a supplier, vendor, or retailer.
- Item is prohibited for sale on Aaksha.

Must be signed, a limited first edition, out of print, or have other desirable qualities that could reasonably be assumed to increase the book’s value to a collector — you will have an opportunity to say why.
What we will not accept for sale:
Moldy, badly stained or unclean copies; copies with missing pages or obscured text; promotional books, including advance reading copies. Uncorrected proof copies are prohibited.
Make sure that you describe your books in an accurate manner. An accurate product description increases buyer satisfaction, helps sellers build a loyal customer base, and ensures positive feedback ratings. The presence of a remainder mark should always be noted in comments.
Electronics & Photo
New Electronics & Photo items
A brand-new, unused and unopened item in the original packaging with all of the original packaging materials included. The original manufacturer’s warranty, if any, should still apply, with details of any such warranty included when you complete the Add your comments section of the product listing.
What we will not accept for sale:
Electrical and photographic items that do not work perfectly in every regard or are damaged in ways that render them difficult to use. Items not manufactured or printed by the original manufacturer. Electrical items without CE marks are not acceptable.
All electrical and photographic equipment must be safe (that is, there is no risk that the equipment will cause death, personal injury or damage to property), and where applicable, come fixed with an Indian standard plug. You must not list any product that has been the subject of a product safety recall.
Ink and Toner Cartridges
A brand-new, unused, unopened ink or toner cartridge in its original packaging and with all original packaging materials included. The original manufacturer’s warranty, if any, still applies, with details of the warranty included in the comments on the item’s condition.
Videos and DVDs
Collectible videos and DVDs
Must be rare, out of print or otherwise unique–you will have an opportunity to say why your copy is collectible.
New videos and DVDs
A brand-new, unused, unopened video or DVD in perfect condition in its original packaging and with all original packaging materials included.
What we will not accept for sale: Video or DVD recordings not created by the copyright holder, including recopied media in any form. In addition, promotional media is prohibited for sale through Aaksha, as are recordings in which any aspect of the film is missing or obscured.
Please note: 18+certificate videos or DVDs can only be listed if the seller is at least 18 years of age.
New videos and DVDs
A brand-new, unused, unopened video or DVD in perfect condition in its original packaging and with all original packaging materials included.
What we will not accept for sale:
Video or DVD recordings not created by the copyright holder, including recopied media in any form. In addition, promotional media is prohibited for sale through the Aaksha marketplace, as are recordings in which any aspect of the film is missing or obscured.
Note: 18+certificate videos or DVDs can only be listed if the seller is at least 18 years of age.
Video Games
New video games
A brand-new, unused, unopened video game in perfect condition in its original packaging and with all original packaging materials included.
What we will not accept for sale
Video games that are not playable or are incomplete, including shareware and freeware versions; games not published by the original manufacturer, including recopied media in any form. Promotional media is prohibited for sale through Aaksha.
Toys
New toys
A brand-new, unused, unopened toy, in perfect condition.
Collectible toys
Must be unique–you will have an opportunity to detail why your toy is collectible.
What we will not accept for sale
All toys must be safe (that is, there is no risk that the equipment will cause death, personal injury or damage to property). You must not list any product that has been the subject of a product safety recall.
In addition, promotional items are prohibited for sale through Aaksha.
Consumable, Ingestible, and/or Topical Products
All consumable, ingestible, and/or topical products sold on Aaksha.in must be listed in New condition. This includes, for example, items within the Beauty, Food & Grocery, Health Care, and Vitamins & Dietary Supplements categories. To be considered New, items must not have been previously used, be in the original packaging, and be properly prepared, packaged, sealed, and labelled to prevent contamination, spoiling, melting, and damage.
Products cannot be listed in New condition if the items have been used, have any signs of use, damage, or were intended for destruction or disposal or were otherwise designated as unsellable by the manufacturer or a supplier, vendor, or retailer.
To ensure that customers are able to buy with confidence from all sellers, you may be required to obtain approval to list certain products. For more information, see Categories Requiring Approval in this terms page following few sections.
Selling Ink and Toner Cartridges
Categorize ink and toner cartridges according to the definitions below. Please take a moment to familiarize yourself with these definitions.
All three listing types mentioned below should be offered on a separate product detail page, with individual barcodes assigned to each page.
Original ink or toner cartridge in retail packaging
An original ink or toner cartridge manufactured by the company that manufactured the printer in which the cartridge is used (such as, Hewlett-Packard, Canon, Epson, Lexmark, Brother, etc.), and which is in its original retail packaging.
Re-manufactured and refilled ink or toner cartridge
An original branded cartridge that has been used, re-manufactured, and refilled with ink or toner. To varying degrees, the cartridge may have been taken apart, cleaned, and had parts replaced.
Compatible ink or toner cartridge
An ink or toner cartridge designed to work with a particular printer, but which was not manufactured by the company that manufactures the printer in which the cartridge is intended to be used. These cartridges are produced using mostly new or all new parts and components.
Sell software
Only full retail versions of physical software may be sold on Aaksha.in. Please take a moment to familiarise yourself with this list of prohibited items:
Duplicated or copied software:
Sellers are not allowed to sell any software that has been copied by anyone other than the original software manufacturer.
Digital Download
In order to protect customers, sellers and rights owners from digital piracy, sellers are not allowed to sell digitally downloadable software by any means whatsoever, including by way of activation codes, registration links, licence keys, serial numbers, or any other credentials related to software products. For the avoidance of doubt, this prohibition includes, but is not limited to, providing access/activation information by e-mail, Our messaging system, third-party sites, any electronic channels, or by way of printed or physical form.
Any software that was not intended by the manufacturer for retail sale:
Sale of any software that was not designed or intended for retail sale by the manufacturer is prohibited for sale. This includes:
OEM software:
Original equipment manufacturer (OEM) software comes bundled with, installed on, or packaged with computer hardware. You cannot sell this software unless you are also selling it with the associated hardware and listing it against the hardware EAN/UPC.
Freely distributed or Promotional software:
Software distributed freely by manufacturers, including freeware, shareware and promotional software.
Beta (pre-release) versions:
Software distributed for the purpose of troubleshooting, testing and evaluation.
Freeware and shareware:
Software distributed free of charge by the copyright owner.
Backup copies:
Copies that are made to protect the purchase of a software title. This software cannot be distributed, shared or sold.
Expired subscription-based software:
Software that is no longer usable because it has passed its subscription time period.
Academic software
Academic software is software that is sold to students, faculty, and educational institutions expressly for use by those individuals and institutions. Since we has no way of verifying that a seller or buyer has an academic connection, we prohibit the sale of most academic software. To determine if the academic software that you want to list is allowed, please follow these guidelines:
Pre-purchase verification:
Academic software that requires pre-purchase verification is prohibited for sale because we have no way of verifying that the seller or buyer meets the requirements at the time of purchase.
Post-purchase verification:
Academic software that requires post-purchase verification is permitted to be sold. If the licence is non-transferable and/or the buyer will not be eligible for technical support or upgrades, then it is prohibited for sale.
SECTION – 4 – COMMUNICATION GUIDELINES
As part of selling in Aaksha.in, sellers communicate with buyers, both directly and indirectly. We requires that the sellers follow the guidelines below for any communication with the buyers. The Communications Guidelines policy is meant to protect buyers from fraud and abuse, and to protect you from unscrupulous actions from your competitors. Raising the bar for all communications to buyers benefits all our selling partners, resulting in a stronger marketplace.
Direct communication
Order status messages
- Problem with order messages: You must communicate with the buyers if the ordered product is not available to be shipped. Follow these directions and select Problem with order to communicate to the buyer about your inability to fulfil the order. If you think that you can fulfil the order but the shipment will be delayed beyond the advertised availability, then you must notify the buyer about the delay. If the buyer decides to cancel the order, you should then start the refund process.
Note: Do not contact the buyer and request that they submit a cancellation request when you are out of stock.
- Return-related messages: You must process refunds for the order amount (minus any charges) using either Manage orders in Store Manager Dashboard. You may communicate with the buyer about the return only when you need additional information to complete the return or you are offering a partial refund. Follow these directions and select Follow-up on return request.
Buyer-Seller Messages
You may only send Permitted Messages to customers who have contacted you about purchasing a product or who have already purchased a product from you. We define Permitted Messages as those communications necessary to complete an order or to respond to a customer service inquiry.
Proactive Permitted Messages are those messages that you initiate and which are not responses to a buyer’s question. Proactive Permitted Messages can be sent via email, Chat Box in Store Manager Dashboard. You may send proactive Permitted Messages for the following reasons: resolving an issue with order fulfilment, requesting additional information required to complete the order, asking a return-related question, sending an invoice, requesting product review or seller feedback, or both, scheduling the delivery of a heavy or bulky item, scheduling a Home Services appointment, verifying a custom design, or any other reason where the contact is required for the buyer to receive their purchase. Proactive Permitted Messages must be sent within 30 days of order completion. All proactive Permitted Messages must be in the buyer’s language of preference. Permitted Messages do not include any of the following message types (in many cases, we are already emailing customers with this information on your behalf):
- Order or shipment confirmations (Refer to the Indirect communication section below)
- Messages that say only ‘Thank you’ or that you are here to help if buyers have any problem
- Marketing or promotional messaging, including vouchers
- Language that either incentivises or persuades the buyer to submit positive product reviews or seller feedback, including by offering compensation, money, gift cards, free or discounted products, refunds, rebates or reimbursements, or future benefits
- Language that requests removal or an update of an existing product review
- Language that requests a product review only if they have had a positive experience with the product
- A repeat request (per order) for a product review or seller feedback
Permitted Messages may not include any of the following:
- External links unless they are secure working links (https, and not http) that are necessary for order completion, or links to Aaksha.in
- Attachments for those needed to resolve a buyer’s issue (for example, shipping labels, invoices, and custom designs)
- Logos, if they contain or display a link to your website
- Link to opt out of messaging
- Sensitive content in images or text (for example, bare skin, violence or gore, adult or offensive language)
- Tracking pixels or images
- Email addresses
- Telephone numbers, except those related to warranties, shipping providers, or manufacturers
- Images of purchased products as Aaksha.in includes those on your behalf
- Images that do not relate to your brand or company
Permitted Message styling may not contain any of the following:
- Accessibility issues from links without explanatory text (for example, Click here for warranty information), or images or graphics without alt-text
- Emojis, including emoticons
- Animated GIFs
- Message margins over 20% of maximum width
- Image or graphic sizes larger than 80% of maximum width
- Overrides of default line height, font family, or font colour
- Fonts in more than three sizes
- Message bodies that are centred or that otherwise override the default text alignment settings
- More than two line-breaks (spacing between paragraphs) in a row
- Unsecure images (http instead of https)
- Egregious spelling errors or grammar issues

Indirect communication
We communicates order-related information to the buyers through their Your account updates. These updates include information, such as when an order has been shipped (with the tracking number) or when a refund has been processed. These updates are based on shipment confirmations and refunds initiated using Manage orders or the following feeds:
- Shipping Confirmation feed: This feed tells Aaksha that you have shipped buyer orders and provides order tracking information for the buyers. Timely communication of order status is an important part of a high-quality shopping experience for buyers.
Note: We require you to promptly confirm shipment of all orders, either by using Manage orders or by uploading a Shipping Confirmation feed. Once you have confirmed a shipment, we will send a confirmation email to the buyer.
- Order Adjustments feed: This feed tells Aaksha that you have issued buyer refunds. Buyers want to know their refund status after returning products. Therefore, it is critical that you process refunds promptly. You can also use Manage returns to issue a refund.
Failure to comply with these communication guidelines may result in Aaksha limiting Permitted Messages to a suspension of selling privileges. We have the authority to block any message at its discretion.
SECTION – 5 – INTELLECTUAL PROPERTY ANTI-COUNTERFEITING POLICY
Customers trust that they can always buy with confidence on Aaksha. Products offered for sale on Aaksha.in must be authentic. The sale of counterfeit products, including any products that have been illegally replicated, reproduced or manufactured, is strictly prohibited.
We take product authenticity very seriously. It is each seller’s responsibility to source and sell only authentic products. If you sell counterfeit goods, then we can immediately suspend or terminate your selling privileges or return. In addition, if we determine that a seller account has been used to engage in fraud or other illegal activity, including selling of counterfeit products which might result in a significant number of customer disputes or other claims, then remittances and payments can be withheld or forfeited. The sale of counterfeit goods can lead to legal action by rights holders and also result in civil and criminal penalties.
We are constantly innovating on behalf of our customers and working with manufacturers, content owners, brands and sellers to improve the ways by which we detect and prevent counterfeit products from reaching our online marketplace. We work hard on this issue everyday because we know that our customers trust that they are buying authentic products when they shop on Aaksha.in.
We also encourage anyone who has a product authenticity concern to notify us, and we will investigate it thoroughly and take appropriate action.
SECTION – 6 – INTELLECTUAL PROPERTY POLICY
Aaksha is dedicated to providing customers with the widest selection of goods on Earth and creating an amazing customer experience. We does not allow listings that violate the intellectual property rights of brands or other rights owners.
This page provides information about intellectual property (IP) rights and common IP concerns that might arise when selling on Aaksha. This is not legal advice. You must consult a lawyer if you have a specific question about your IP rights or the IP rights of others.
Copyright
What is a copyright?
Generally, copyright law is meant to incentivise the creation of original works of authorship for the benefit of the public. To receive copyright protection, a work of authorship must be created by an author, and must have some amount of creativity. If you are the author of an original work, then you typically own the copyright in that work.
The Copyright Act, 1947 (“Copyright Act“) is the law that governs copyright materials in India. The Copyright Act applies to copyrights only, and not to trademarks or patents.
How do I know if I own the copyright for one or more of the images that I am using on the Product Detail Page?
A person who authors an original work usually owns the copyright for that work based on certain conditionalities. If you take a photo of your product, then you generally have copyright protection in the photo that you took, and you can use that photo on your Product Detail Page to sell that product. However, if you find a photo on someone else’s website, then you should not upload that photo to a Product Detail Page without the other person’s permission.
Note: When you add your copyrighted image to a Product Detail Page, you grant us a licence to use the material. Other sellers can list their items for sale on pages to which you have added your copyrighted images, even if you no longer sell that product. To ensure that you are not violating someone’s copyrights, please make sure to upload only images or text that you have created yourself or for which you have the copyright holder’s permission to upload.

How do I know if I own the copyright for the product that I am selling?
It is important to make sure that the goods which you are selling do not violate a copyright, or you could lose your selling privileges and face potential legal consequences.
Trademark
- What is a trademark?
A trademark is a word, symbol or design, or a combination of same (such as a brand name or logo) that a company uses to identify its goods or services and to distinguish them from other companies’ goods and services. Put another way, a trademark indicates the source of goods or services. Generally, trademark laws exist to prevent customer confusion about the source of goods or services.
A trademark owner usually protects a trademark by registering it with a country-specific trademark office (such as the Office of the Registrar of Trade Marks). In some cases, a person or company might have trademark rights based on only the use of a mark in commerce, even though the mark was never registered with a country-specific trademark office. Those rights are known as “common law” trademark rights and can be more limited.
- What do trademarks protect?
Generally, trademark law protects sellers of goods and services from customer confusion about who provides, endorses, or is affiliated with particular goods or services. A trademark owner might be able to stop others from using a particular mark, or a deceptively similar mark, if using the mark is likely to cause a customer to be deceived or confused about whether the product being sold is the trademark owner’s product.
- What types of trademarks are displayed?
Trademarks are often displayed on product detail pages in the form of product and brand names listed on a product detail page.

- Do I always need the rights owner’s permission to use a trademark?
Just because you are not the owner of a trademark does not necessarily mean that you cannot sell another company’s product. Usually, the unauthorized use of a trademark in the creation of a product detail page is infringing only if it is likely to cause confusion as to the source, endorsement, or affiliation of the goods.
- How can I make sure that I am not violating trademark law when selling?
It is important to make sure that the goods you are selling, and the content of your listings, do not violate a trademark or you could lose your selling privileges and face potential legal consequences. When you decide to sell goods, ask yourself the following questions:

- Are the goods I am selling from a reputable distributor?
- How did I acquire these goods, and will I be able to prove they are authentic if the question arises?
- Will the way I am describing these goods cause customer confusion?
- Did I use a brand name or trademark in a non-confusing and truthful manner to describe compatibility (generally allowed) instead of deceptive similarity (not allowed)?
- What is Counterfeiting?
Counterfeiting is a specific type of trademark infringement. A counterfeit is an unlawful reproduction of a registered trademark, or a mark that is very similar to a registered trademark, in connection with the sale of a product that does not come from the trademark holder.
Counterfeiting requires the use of a trademark on the product or packaging.
A look-alike item sold on a separate product product detail page without the improper use of a trademark is not a counterfeit, even though the item might look similar or identical to the trademarked product.
Patent
What is a patent?
A patent is a form of legal protection for inventions. An issued patent grants its owner the right to exclude others from making, using, offering to sell, selling, or importing the invention into India for a fixed number of years.
Patents may be granted for a new machine, articles of manufacture, composition of matter, process, or improvement to any of those, and generally protect the structure and functions of a product rather than how it looks.
What is the difference between a patent, trademark, and a copyright?
A patent is different from a trademark in that it protects an invention (such as a new machine or idea) rather than a word or logo used to identify the source of the product (such as the brand name of the product). A patent is different from a copyright in that it does not protect the expressive content of a creative work like a book or a picture, but protects a specific invention, such as a new method of printing books or a new type of camera.
How can I make sure that I do not violate someone’s patent when selling?
The manufacturer or authorized distributor of a product might be able to assist you with patent-related issues. If you are unsure whether your content or product violates someone else’s patent, you should consult a lawyer before listing.
Industrial Designs
What is an industrial design?
An industrial design is a form of legal protection for an original ornamental plastic form of an object or set of lines and colours that may be applied to a product. An industrial design protects the appearance of a product and is intrinsically linked to a product.
How can I make sure that I do not violate someone’s design when selling?
The manufacturer or distributor of a product might be able to assist you with design-related issues. If you are unsure whether your content or product violates someone else’s design, then you should consult a lawyer before listing.
Designs
- What is a design?
In India, designs are regulated/protected under the Designs Act, 2000 (“Design Act”). A design is the features of shape, configuration, pattern, ornament or composition of lines or colours applied to any article whether two dimensional or three dimensional or in both, by any industrial process or means, whether manual, mechanical or chemical, separate or combined, which in the finished article appeals to and is judged solely by the eye.
- How can I make sure that I do not violate someone’s design when selling?
It is important to make sure that the products which you are selling, do not violate a registered design. For example, you should not imitate a registered design, except with the licence or written consent of the registered proprietor.
- What can be registered as a design?
To meet the criteria of a valid design and be registered under the Design Act, a design must be (i) new or original; (ii) undisclosed to the public anywhere in India or in any other country by publication in any tangible form or not in use in any other way; (iii) significantly distinguishable from known designs or combination of known designs; and (iv) not contain obscene or scandalous matter.
When a design is registered, the registered proprietor of the design shall, subject to the provisions of the Design Act, have copyright in the design for 10 years from the date of registration.
What to do if your account receives a warning or suspension
- What happens when I receive a warning that my listing is being removed due to a report of intellectual property rights infringement? What if I own the rights to the intellectual property?
If you receive a warning for infringement, then you will have several options to appeal or dispute the claim:

- If you receive a warning for a product that you never listed, then please reply to the notification that you received and let us know that you have never listed the reported product. We will investigate to determine if an error occurred.
- If you have an established relationship with the rights owner who submitted the complaint (such as, licence, manufacturing or distribution agreement), then we encourage you to reach out to the rights owner and request that the complaint be retracted. If we receive a retraction from the rights owner, then your content may be reinstated. The rights owner’s contact information is provided in the warning that you received.
- Trademark Response: If you believe that a rights owner, or us, made an error when removing your product listing for counterfeiting or trademark infringement, then please reply to the notification that you received and provide specific reasons as to why you believe a mistake was made. Please provide any invoice or Order ID that demonstrates the authenticity of the product. We will then re-evaluate the notice and your content may be reinstated.
- Patent Response: If you believe that a rights owner, or us, made an error when removing your product listing for patent infringement, then please reply to the notification that you received and provide specific reasons as to why you believe a mistake was made.
- Copyright Response: If you believe that a rights owner, or us, made an error when removing your product listings for copyright infringement, then please reply to the notification that you received and provide specific reasons as to why you believe a mistake was made. You may also seek appropriate remedies available to you under applicable laws.
- What do I do if I have received multiple warnings of intellectual property infringement?
If you have received multiple warnings of intellectual property infringement and you believe that you are selling authentic products, then please appeal with the following information:
A list of the allegedly infringing EAN/UPC and at least one of the following:

- Invoices proving the authenticity of your products; or
- Order IDs demonstrating product authenticity; or
- An authorisation letter from the rights owner (that is not a forwarded e-mail)
What do I do if my account has been suspended?
If your account has been suspended as a result of rights owners submitting notices of intellectual property infringement against your products or content, then you can provide us with a viable Plan of Action that includes the following information:

- The reasons why you were selling allegedly infringing products or uploaded allegedly infringing content, or both
- The steps which you have taken to ensure that you are no longer infringing;
- How you will avoid infringement in the future; and
- Any other pertinent information
You must send your Plan of Action via reply to the account suspension notification that you received. We will evaluate your Plan of Action and determine if your account may be reinstated. Please note that we terminates the accounts of repeat infringers in appropriate circumstances.
What if I did not know I was violating someone’s intellectual property?
Sellers are expected to follow the law and all our policies. We takes claims of intellectual property infringement seriously. Even if a seller is infringing on someone’s intellectual property without knowledge, we will still take action and the seller’s account might receive a warning or be suspended. You should consult an attorney for help to ensure that your business has the right procedures in place to prevent IP infringement.

What is Brand Infringement Policy?
We follows an infringement policy against reports when the appropriate owner of the brand complains about other sellers misusing their brand name. All violations are highlighted via infringement form for us to take the right action.
Why it is important to protect your brand?
We always encourages its sellers to have a single detail page for the same item. If a different item is added to the same listing then buyers will receive a different product and not what is advertised on the detail page. Additionally, product quality in most cases is not at par with the original product, hence the product might get a negative feedback impacting the product rating. This will create a bad seller and buyer experience.
What are you required to do while filing the Trademark Infringement form?
- Mention the trademark application number and product class details in your submission.
- The trademark application should be in registered status as per Trade Marks Registry India records.
- Check that the wordmark you are applying for as trademark is same as the brand updated on the products’ detail page.
- Ensure that your products are uniquely identifiable on the detail page through your private label’s logo or brand name imprinted/engraved on the product or packaging. This must be clearly displayed on the detail page of the product and the images on the detail page should not be digitally enhanced/modified using any imaging software.
- Confirm that you have created the Product.
- Make sure that you are reporting against a different product being sold against your listing and not against another seller for selling the same product without your authorisation. Please note that Indian laws don’t allow any restrictions against selling of a genuine product.
SECTION – 9 – PACKAGING AND LABELLING GUIDELINES FOR DANGEROUS GOODS
Dangerous goods (also called Hazardous Materials or ‘hazmat’) are defined by us and/or by various regulatory bodies as substances or materials that can pose an unreasonable risk to health, safety, or property or the environment in storage, handling, or transport. You are expected to adhere to guidelines in order to be compliant with the special regulations and procedures for shipping dangerous goods.
When shipping dangerous goods, the packaging and labelling is utmost important to safeguard the people that handle the shipment and contents of the shipment. See the following guidelines to safely pack the dangerous goods containing shipments. We may refuse shipments that do not meet these guidelines. Note that the guidelines are divided into two parts: packaging guidelines for lithium batteries, and packaging guidelines for dangerous goods products other than lithium batteries.
Packaging guidelines for lithium batteries are as follows.
One of the major risks associated with the transport of batteries and battery-powered equipment is short-circuit of the battery as a result of the battery terminals coming into contact with other batteries, metal objects, or conductive surfaces. Consider the following when transporting lithium batteries:
- Packaged batteries or cells must be separated in a way to prevent short circuits and damage to terminals.
Batteries must be packed in a strong, rigid outer packaging.
- Paste suitable lithium battery labels on the outermost packaging of the product for all orders containing items with lithium batteries:
- UN3481 marks on packages containing lithium ion batteries contained in equipment or lithium ion batteries packed with equipment.
- UN3091 label on packages containing lithium metal batteries contained in equipment or lithium metal batteries packed with equipment.
- UN3480/UN3090 for standalone lithium ion/standalone lithium metal batteries.
* Denotes space for UN number(s), i.e. UN3090, UN3091, UN3480 and/or UN3481, as applicable. The UN number(s) indicated on the mark should be at least 12 mm high.

- For shipping products containing lithium batteries, make sure that you have additional packaging over the manufacturer’s box and never ship the item only in the manufacturer’s packaging.
Packaging guidelines for dangerous goods products, other than lithium batteries, are as follows.
- The shipment should be packed in rigid outer packaging.
- If the shipment contains liquid state products, avoid using glass bottles as inner packaging.
- For liquid state products, the inner packaging should have absorbent material between inner and outer packaging to absorb the liquid in case of incident. Products with a dispenser-model neck should be prepped to ensue that no damages happen in transit.
- The shipment should have cushioning material (for example, bubble wrap or paper) between the inner and outer packaging.
SECTION – 10 – YOUR OBLIGATIONS WHEN SHIPPING
Seller will not send customers e-mails concerning shipping confirmation of Seller Products.
Promptly after shipment of a customer’s order (or any portion of the customer’s order), Seller will accurately inform Aaksha.in that the order has been shipped (and, in the case of a customer order that is shipped in more than one shipment, accurately inform Aaksha.in which portion of the order has been shipped), using the standard functionality made available by aaksha.in for communicating such information (“Shipment Details“).
If seller fails to provide Confirmation of Shipment within the time frame specified by us (e.g. 24 hours after the last date of estimated ship date for seller-fulfilled orders), we may in its sole discretion cancel (and/or direct seller to stop and/or cancel) any such seller transaction, and seller will stop and/or cancel any such seller transaction upon such request by Aaksha.in.
Seller will comply with any instructions from the manufacturer, distributor and/or licensor of a product regarding Street Date for Delivery (which means the date, if any, specified by the manufacturer, distributor and/or licensor of a product as the date before which such product should not be delivered or otherwise made available to customers) or the Street Date for Disclosure (which means the date, if any, specified by the manufacturer, distributor and/or licensor of a product as the date before which specified information regarding such product (e.g., title of a book) should not be disclosed publicly).
The above terms and conditions are in addition to and are not intended to eliminate any rights we may have, or any obligations Seller or any of its Affiliates may have, under any agreement currently in effect between Seller or its Affiliates and Aaksha.in or its Affiliates concerning the offer and/or sale by Seller or its Affiliates of products or services via the Aaksha.in Site (“Seller Agreement“). The above terms and conditions are hereby incorporated into the Seller Agreement, and to the extent that any of the above terms and conditions are inconsistent with the Seller Agreement, the Seller Agreement is hereby amended as necessary to be consistent with the above terms and conditions. Capitalized terms used and not defined herein have the meanings ascribed to them in the Seller Agreement.

Together, they guarantee great customer experience, reduced damages and hence better seller rating. It is strongly advised that sellers go through the following details:

- Check whether the product picked for packing is same as the one ordered by customer by checking the following attributes
- Product Name
- Color of the product
- Accessories that has to bundled or included, if any
- Part Number/Model Number/Version
- Check whether all items captured in the product image at Aaksha.in catalogue are included
- Package seal should be intact and no tampering or scratches.
- Ensure that any offers or freebies mentioned in the product are included.
- The product should be dusted clean
Wrap items individually with cushioning material and if required use rubber band, instead of a taping the cushioning material, so that it covers the item intact.
- Bundle accessories, if any, along with the main product. No accessories/sub-items should be loose inside the box.
- b) Product packing
- Most products come with manufacturer packaging that is not robust enough. Hence it is mandatory that products are packed into a corrugated outer box or thick covers
Place the prepped item in the center of the corrugated box. Fill the empty spaces with sufficient fillers so that product doesn’t move inside the box during the transit. Lesser empty space inside the box, the better.
- Ensure using double-walled boxes for heavy items like laptops, cameras, printers and home appliances
- Place a duplicate address label inside the package
- c) Addressing & labelling the package
- Apply tape evenly across flaps both at the top and the bottom. Use H taping method as shown in the diagram.
- Place shipping labels on the package’s largest surface. Label should not be on the tape.
- Only sticky labels should be used for printing shipping labels. Use sticky paper of good quality to print the labels. The size of a label should be 4 x 6 inches.
- Shipping label shouldn’t be folded along any edges, and it should not be pasted on the edges of the packet

Liquids
Ensure to position the products that contain liquid upright. Use an inner seal and perforated breakaway cap. Prep it with 50 micron+ polythene bag so that even if leakage happens it does not get spilled over to the outer package.
Apparels, small items & Soft toys
Place the product in a transparent 50 micron+ poly bag with a suffocation warning and seal the bag to protect it from damage or dust. Poly bag protrusions beyond 3 inch are not recommended.
Fragile & Sharp Items
Mark “Item fragile” label on all sides of the box. Instapak foam is the most preferred cushion material for fragile items. Outer box should contain signs or labels (“This Side Up”) on product handling.
Items with sharp edges needs to be sufficiently prepped with cushioning material covering all edges and not leaving any edge open
Books
Seal the books using either a shrink wrap or a 50 micron+ polythene cover so as to protect it against wet delivery conditions. It is always better that books get box shipped and not bagged or mailed in an envelope.
- Don’t use newsprint for covering books as it might cause a permanent discoloration, especially to book edges
- Check if the CD/DVD accompanying the book is in place.
- Check if the product edition mentioned in the catalogue and that of the product shipped are same
- Check whether hardback or paperback is ordered and the right format shipped
- Ensure no smudges/smears are there on the books
Electronics
- Ensure all the accessories are included as described in the product and in the catalogue of Aaksha.in
- Check whether the right model and color is shipped as bought by the customer
- Seal has to be intact
- Item should be shipped in original package.
- In case of accessories, ensure that the item sent is for the same model as mentioned in the catalogue ordered by customer
4) Packaging Don’ts
- Shipping with original manufacturer’s packaging is not recommended.
- Avoid package labels pasted on the corners/edges of the box/ on the tape
- Unauthorized marketing materials (e.g., pamphlets) are prohibited
- Packing material of other vendors should not be used.
- Items not meant for retail should not be sold.
- Check for the expiry date before packing wherever applicable and ensure sufficient time lapse is there between shipping and expiry date.
- Do not use cellophane tape, duct tape, masking tape, string, rope to seal packages.

General Bundle Policy
- The referral fee for the primary product’s category (the same category used to list the product) applies to the entire bundle.
- All products in bundles must comply with product listing policies.
- Bundle images, features, and descriptions must also adhere to listing policies.
- Failure to adhere to the Bundle Policy, including the following Detailed Bundle Guidelines, may result in the removal without notice of any bundled product listing, account suspension, or both. We reserves the right to modify or revoke this policy at any time.
Detailed Bundle Guidelines
Bundle Listing and Categorization:
- Bundles must consist of items that are highly complementary (this means items in the bundle enable or enhance the use of other items in the bundle or provide convenience to the buyer by purchasing them together).
- Bundles consist of multiple single items that can each be identified by a unique EAN/UPC and are sold together as a single offering. A pre-packaged kit or pack with multiple items that is identified by a single EAN/UPC is not considered a bundle.
- A bundle may be listed in a single category only, even if the products comprising the bundle are from multiple categories. If a bundle includes products from multiple categories, it may be listed only in the category of the highest priced item in the bundle.
- The bundle must have its own standard product identifier or manufacturer part number. The identifier of any individual product in the bundle may not serve as the identifier for the bundle. Using a UPC from any single product in the bundle to identify the entire bundle may lead to immediate removal of the listing. You are responsible for obtaining a UPC for each bundle you create.
- Do not include generic products in a bundle, as it may mislead customers into thinking the generic product belongs to the same brand as one of the branded products in the bundle. Generic products are identified as items with no brand whatsoever on the product or packaging (not just widely unrecognized brands).
- If an item is a multi-pack, such as pack of 4 markers, list it as a single product and not as a bundle. See UPCs and Item Package Quantity for Multi-Packs.
- If an item is a variation of a parent product, list it as a variation within the parent product’s family and not as a bundle. See Creating Parent/Child Variation Relationships.
- If you match your bundle to an existing bundle listing, the products in your bundle must be exactly the same as the products in the existing bundle in every respect. If your bundle is different in any way, you must create a new bundle listing. You may not change the existing listing to align to the specifications of your new bundle.
- Once you create a bundle, you may not modify the components of that bundle. If you want to add or remove products from the bundle, you must create a new bundle listing with a unique UPC or match to an existing bundle listing that is identical to your revised bundle.
Bundle Warranties and Returns:
- If you list a product bundle, you must accept the entire bundle as a return and refund it as a single unit.
- A bundle cannot contain any separate warranty products or extended service plans.
Bundle Titles:
- Bundle title length should align to title length rules in listing policy.
- Include the word “Bundle” and the number of items in the bundle in the product title. For example:

- If the bundle includes only a few items, list them in the title. For example:

Bundle Product Details and Images:
- Feature Bullet 1 in the detail page for your bundle must state that the product is a bundle of “X” number of items and must identify the products in the bundle.
- The description in the detail page for your bundle must state that the product is a bundle and must also identify the products in the bundle (with appropriate designators, such as model number, color, and size).
- The main image for the bundle must include the specific products in the bundle (and must not include any items that are excluded from the bundle). Images of representative or similar products are not permitted.
Requirements for product EAN/UPCs and GTINs
Understanding Product IDs
Product ID – UPCs/EANs/GTINs/Barcodes
Product ID is a unique identifier of your product. It is a 10 to 14 digit number that is commonly known as a Barcode or Global Trade Item Numbers (GTINs).
Is Product ID mandatory to add products?
Product ID is mandatory to add a new product.
Important:
- Certain products are not allowed on the Aaksha.in website under any conditions, even if you have a GTIN available. To learn more, please read about Restricted Products.
- We verify the authenticity of product UPCs by checking the GS1 database. UPCs that do not match with the information provided by GS1 will be considered invalid. We recommend obtaining your UPCs directly from GS1 (and not from other third-parties selling UPC licences) to ensure that the appropriate information is reflected in the GS1 database.
- All invalid product UPC listings will be removed
Image guidelines for clothing
Good images are important to your products’ success. In an online store, the product image is one of your most valuable marketing tools.
When customers browse, often the image draws them to consider your product. In addition, with so many choices available for online purchases, a well-formed image can set your product apart from the others. Poor quality images turn away customers. Use your product images to communicate the selling points and features of your products, to inform and interest customers, and to reinforce your brand. Every SKU must have a main image.
Types of images:
We displays several images for each product in the catalogue. As a seller, it is in your interest to provide several high-resolution product images for your products so customers can make informed buying decisions. You can use four types of images to illustrate your products:
- The parent SKU main image, used for the product detail page (the page that customers see when they search or browse the catalogue). Only one main image is used per parent product. The main image appears as a smaller representation of the full-size image on the product detail page. When customers click the smaller picture, the full-size picture appears in a pop-up window. You must supply a parent main image.
- The Child SKU main image, used to show a view of the product in the specific colour for the given child SKU. The main image for the child SKU shows in the image pop-up window. Each child SKU has just one main image, representing the child product in the specified colour. You must supply a child main image for every colour that you sell.
- Alternate images, used to show different views of the product to help clarify use, detail, fabric, cut or other ways to view the product, or to show related products. You can supply up to eight alternate images for each parent or child SKU. The alternate image for a parent product appears in the image pop-up window. If a customer clicks a specific colour in the image pop-up window (for example, a blue sample), then the pop-up window shows the alternate image for the “blue” SKU.
- Swatch images, used to show different available colours, fabrics or other choices for products. You can supply one swatch image per child SKU. Swatch images display on the product detail page next to the name of the colour. Product detail pages show the main image for the parent product. Swatch images for child products, if available, appear below the main image as 30 x 30 pixel thumbnails. Swatch images help customers see other aspects of your product, such as colour or detail. Swatch images must not include text or pricing details.
Product image requirements
Images are an important part of selling products. They make it easier for customers to evaluate and learn about your product.
Technical requirements:
We prefer images larger than 1,000 px on each side to allow for zoom. We also prefer the JPEG file format. Every product must have at least one image. We recommend having at least six images and one video.
All images must be:
- 500 px to 10,000 px on their longest side,
- JPEG (.jpg or .jpeg), TIFF (.tif), PNG (.png), or non-animated GIF (.gif) file formats, and
- clear, unpixellated, and have no jagged edges.
Main product images:
We call the first image on the detail page the “main product image.” This image is also shown to customers in search results.
Your main product image must:
- Accurately represent the product as a realistic, professional quality image and not be a placeholder.
- Have a pure white background (RGB colour values: 255, 255, 255). This allows us to create a consistent shopping experience for customers across search and product detail pages.
- Show the product as 85% of the image.
- Not have text, logos, borders, colour blocks, watermarks or other graphics covering the product or in the background. Products with multiple pieces must be relative in size, with no one piece enlarged.
- Show the entire product within the frame of the image, not cutting off any part.
- Not show accessories that are not included with purchase or any props that might confuse the customer.
- Only show the product once in the image (example: front only and not both front and back).
- Show only one unit of the product and any accessories that are included in the purchase. For multipacks or assortments, see further guidance in the “Product category” section.
- Not include packaging, unless it is an important product feature, for example, a carrying case or gift basket may be included.
- Not show any part of a mannequin, regardless of the mannequin’s appearance. This includes being clear, solid-colour, flesh-toned, framework or on a hanger.
- Show a single shoe, facing left, at a 45-degree angle (applies to all footwear).
- Show clothing accessories or multipacks flat with no model.
- Be on a model if it is clothing in adult sizes. The model must be standing, not sitting, kneeling, leaning or lying down. However, we encourage representing various physical mobilities and models who use assistive technology, such as wheelchairs and prosthetics.
All product images:
All product images, main or otherwise, must:
- Accurately represent the product that you are selling.
- Match the product’s title.
- Not contain nudity or be sexually suggestive. This includes both models and drawings.
- Show children’s clothing flat, not on a model.
- Not include customer reviews, five-star imagery, claims (for example, free shipping) or seller-specific information.
- Not include text or pricing details (Swatch only)
SECTION – 13 – DUPLICATE CASES POLICY
Aaksha’s Selling Partner Support team aims to resolve seller questions or issues as quickly as possible. Duplicate cases on the same issue are not permitted since this takes away from our ability to properly serve our sellers.
If your issue is time sensitive, please flag your case as Urgent for your Selling Partner Support associate. If you believe that an existing case was not handled in accordance with policies, please appeal the case by reopening it.
The following duplicate case actions are not permitted:
- New case seeking a different outcome than the one granted on an existing case
- New case requesting a status update on an existing case
- New case addressing a subset of the issue addressed in an existing case
- New case to readdress an addressed issue by coupling it with a new issue
We may not handle any duplicate cases resolved past the reopen window. If we detect duplicate cases, we may limit your ability to reopen cases or raise new cases.
SECTION – 14 – MUST-KNOW SELLING POLICIES
We enables you to reach millions of customers. We strive to ensure a fair and trustworthy buyer and seller experience. At Aaksha.in, we expect you to adhere to the code of conduct principles outlined below. Violation of the code of conduct principles may result in the loss of your selling privileges and removal from Marketplace.
Code of Conduct Principles
Adhere to the following code of conduct principles while selling on Aaksha.in:
- Adhere to all applicable laws and abide by all policies.
- Maintain current account information.
- Never misrepresent yourself.
- Always act in a manner that ensures a trustworthy experience for customers.
- Never list products that may cause harm to customers.
- Never engage in any misleading, inappropriate or offensive behaviour. This applies to all your activities, including but not limited to:
- Information provided on your account
- Information provided in listings, content or images
- Communication between you and us or you and our customers
- Act fairly at all times. Unfair behaviour includes but is not limited to the following:
- Behaviour that could be deemed as manipulation or gaming of any part of the buying or selling experience.
- Actions that could be perceived as manipulating customer reviews, by directly or indirectly contributing false, misleading or inauthentic content.
- Activities that could be perceived as attempting to manipulate Aaksha’s search results or sales rankings.
- Actions that intentionally damage another seller, their listings or their ratings.
In addition to the above code of conduct principles, all sellers must adhere to the below policies while selling on Aaksha.in:
Policy 1: Unauthorized & improper entry of ‘Business Name’- Do’s & Don’ts
- The ‘Business Name’ entered at the time of registration should accurately reflect the identity of the seller.
- Seller should have the rights to use the said ‘Business Name.’ It should NOT include any trademark, or otherwise infringe on, any trademark or other intellectual property right of any person.
- DO NOT use a ‘Business Name’ that misleads any party (Aaksha or buyer). It should NOT contain an email suffix such as .in, .com, .net, .biz and so on.
Policy 2: Opening of seller accounts- Do’s & Don’ts
- Operating and maintaining multiple seller accounts is prohibited.
- If you have a legitimate business need for a second selling account, you can apply for an exception to this policy.
In your request, provide an explanation of the legitimate business need for a second account. note that in order to be considered for approval, you must:
- Have a separate email address and bank account for the new account.
- Not intend to sell the same products in both accounts.
Policy 3: Listing-Do’s & Don’ts
- Products offered for sale on Aaksha.in must be authentic. DO NOT add any product that has been illegally replicated, reproduced or manufactured (counterfeits).
- DO NOT create a product detail page for a product that is already on the catalogue.
- When listing items for sale using an existing product detail page, it is MANDATORY to ensure that the product being offered accurately describes the one on the product details page in all respects, including aspects such as manufacturer, edition, binding, version, format or player compatibility.
- DO NOT make claims regarding a product’s best seller rank in the product detail page information, including the title and description.
Policy 4: Post Sale-Do’s & Don’ts

- For Shipping, we recommend the use of Aaksha branded packaging material. DO NOT use packaging material, which contains branding of any other online marketplace or e-commerce company. Do not re-use printed packaging material.
- NEVER submit abusive or inappropriate feedback entries, coerce or threaten buyers into submitting feedback, submit transaction feedback regarding themselves, or include personal information about a transaction partner within a feedback entry. Furthermore, any attempt to manipulate ratings, feedback, or product reviews is prohibited.
- NEVER attempt to circumvent the established sales process or to divert users to another website or sales process. Specifically, any advertisements, marketing messages (special offers) or “calls to action” that lead, prompt or encourage users to leave the website are prohibited.
- DO NOT solicit or knowingly accept fake or fraudulent orders, including placing orders for your own products. You may not provide compensation to buyers for purchasing your products or provide claim codes to buyers for the purpose of inflating sales rank.
Policy 5: Handling Customer Information & Communication-Do’s & Don’ts
- ALWAYS be courteous, relevant, and appropriate in all buyer communications. Unsolicited email communications with users, email communications other than as necessary for order fulfilment and related customer service, and emails containing marketing communications of any kind (including within otherwise permitted communications) are prohibited.
- We provides sellers (who fulfil their own orders) access to customer phone numbers so that they can comply with carrier label requirements. If you receive this customer information, you are required to adhere to customer personal information policy, which can be found in our Seller Agreement.
- Buyers and sellers may communicate with one another via the Buyer-Seller Messaging Service. During such conversations, DO NOT provide or solicit direct, non-Aaksha-generated email addresses on the website or in correspondence through the Buyer-Seller Messaging Service.
SECTION – 15 – PROHIBITED SELLER ACTIVITIES AND ACTIONS
Seller Rules are established to maintain a selling service that is safe for buyers and fair for sellers. Failure to comply with the terms of the Seller Rules can result in cancellation of listings, suspension or the removal of selling privileges.
Note: Seller Rules are in addition to, and in no way limit, other seller obligations pursuant to contract or otherwise.
General guidelines
Attempts to divert transactions or buyers:
Any attempt to circumvent the established sales process or to divert users to another website or sales process is prohibited. Specifically, any advertisements, marketing messages (special offers) or “calls to action” that lead, prompt or encourage users to leave the website are prohibited. Prohibited activities include the following:
- The use of email intended to divert customers away from the sales process.
- The inclusion of hyperlinks, URLs or web addresses within any seller generated confirmation email messages or any product/listing description fields that are intended to divert customers away from the sales process.
Unauthorised and improper business names:
Your business name (identifying your business entity on site) must be a name that: accurately identifies you; is not misleading; and that you have the right to use (that is, the name cannot include the trademark of, or otherwise infringe on, any trademark or other intellectual property right of any person). Furthermore, you can’t use a business name that contains an email suffix such as .com, .net, .biz and so on.
Unauthorised and improper invoicing:
Sellers must ensure that the tax invoice is raised in the name of the end customer who has placed an order with them through the marketplace. The tax invoice should not mention Aaksha as either a seller or a customer or buyer. Please note that all products listed are sold by the respective sellers to the end customers and We neither a buyer nor a seller in the transaction. Sellers need to include the VAT/CST registration number of the shipping state in the invoice. Sellers who do not have a VAT/CST registration number and are dealing exclusively in exempted goods like Books or Fabrics/Textiles (unstitched) are exempted from including VAT and CST registration numbers in their invoice.
Inappropriate email communications:
All seller email communications with buyers must be courteous, relevant and appropriate. Unsolicited email communications with users, email communications other than as necessary for order fulfilment and related customer service and emails containing marketing communications of any kind (including within otherwise permitted communications) are prohibited.
Appropriate treatment of customer phone numbers:
We provides Professional sellers who fulfil their own orders access to customer phone numbers so that they can comply with carrier label requirements. If you receive this customer information, you are required to adhere to customer personal information policy, which can be found in our Seller Agreement.
Please review the policy there and the guidance below to make sure that you are using customers’ phone numbers correctly.
- Proper treatment of customer phone numbers:
- Print on labels to comply with carrier requirements.
- Dispose of any customer phone number data that you retain after you have processed the customers’ orders.
- Monitor who in your organisation has access to customer phone numbers—protecting this data is your responsibility.
- Improper treatment of customer phone numbers:
- Never contact a customer using their phone number. To contact a customer about their order, only use Buyer-Seller Messaging Chat Box
- Never share customer phone information with an external party.
- Never pass along customer information of any kind, including phone numbers, outside of Buyer-Seller Messaging.
Direct email addresses:
Sellers are prohibited from providing or soliciting direct, non-Aaksha-generated email addresses on the website or in correspondence through the Buyer-Seller Messaging Service.
Filing Infringement Notices as an Agent or Brand Protection Agency
We understands that many brands may choose to have brand protection agencies or agents report intellectual property infringement on their behalf, and accepts submissions from authorised agents. However, We does not permit individuals with active selling accounts to file infringement notices as an agent of a brand when the filing of those notices could benefit their own selling account (through removing competing listings, for example). Any person filing notices as an agent that benefit their own status as a seller may have their selling account terminated.
Misuse of the selling service:
All sellers are able to access and use the selling service. If a seller uploads excessive amounts of data repeatedly, or otherwise uses the service in an excessive or unreasonable way, it can create a disproportional load and impair the ability of other sellers to easily access and use the service. If a seller is misusing or making excessive or unreasonable use of the selling service, We may, in its sole discretion, restrict or block the seller’s access to product feeds or any other functions that are being misused until you no longer misuse them.
Misuse of ratings, feedback or reviews:
Sellers cannot submit abusive or inappropriate feedback entries, coerce or threaten buyers into submitting feedback, submit transaction feedback regarding themselves or include personal information about a transaction partner within a feedback entry. Furthermore, any attempt to manipulate ratings of any seller is prohibited. Any attempt to manipulate ratings, feedback or product reviews is prohibited.
- Ratings and feedback: The rating and feedback features allow buyers to evaluate the overall performance of a seller, helping sellers to develop a reputation within the Marketplace. You may not post abusive or inappropriate feedback or include personal information about a transaction partner. Please note that this also includes posting ratings or feedback to your own account. You may request feedback from the buyer. However, you may not pay or offer any incentive to the buyer for either providing or removing the feedback.
- Product reviews: Reviews are important to the Marketplace, providing a forum for feedback about product and service details, and reviewers’ experiences with products and services – positive or negative. You may not write reviews for products or services that you have a financial interest in, including reviews for products or services that you or your competitors sell. Additionally, you may not provide compensation (including free or discounted products) for a review. Review solicitations that ask for only positive reviews or that offer compensation are prohibited. You may not ask buyers to modify or remove reviews.
Misuse of sales rank:
The best seller rank feature allows buyers to evaluate the popularity of a product. Any attempt to manipulate sales rank is prohibited. You may not solicit or knowingly accept fake or fraudulent orders, including placing orders for your own products. You may not provide compensation to buyers for purchasing your products or provide claim codes to buyers for the purpose of inflating sales rank. In addition, you may not make claims regarding a product’s best seller rank in the product detail page information, including the title and description.
Post-transaction price manipulation and excessive shipping fees:
Any attempt to increase the selling price of an item after a transaction has been completed is prohibited. Additionally, sellers cannot set excessive order fulfilment and shipping costs. Although we allow shipping charges to be flexible, below are the shipping charge limits for different categories:

All the items can have shipping charges up to INR 120 for apparel and up to INR 80 for other categories irrespective of item selling price.
Accurate descriptions of product information:
When listing items for sale using an existing product detail page, the product being offered must be listed on a product detail page that accurately describes the product in all respects, including with respect to the following attributes: manufacturer, edition, binding, version, format or player compatibility. Sellers may not match their item to a detail page with a different UPC/EAN or other external identifier. * Exception: Club editions of audio CDs should be listed against the detail page for the standard edition of the CD, even if the UPCs of the two editions are different, if the following criteria are met: 1) the content on both editions is identical and 2) a page with the UPC for the club edition does not already exist in our catalogue. Use the listing comments to indicate that the item is a club edition. Format of the products (CD) must be identical.
Misuse of Search and Browse:
When customers use search engine and browse structure, they expect to see relevant and accurate results. Any attempt to manipulate the Search and Browse experience is therefore prohibited. Prohibited behaviours include, but are not limited to:
- Artificially simulating customer traffic (through Internet bots, paying for clicks on organic search results etc.).
- Providing misleading or irrelevant catalogue information (title, bullet points, description, variations, keywords etc.).
- Adding product identifiers (brand names, product names, ASINs and so on), even if they are your own, to hidden keyword attributes.
Branded packaging materials
Do not use packaging material which contains branding of any other online marketplace or e-commerce company. Do not re-use printed packaging material. You can use packaging material with your own brand.
Creating duplicate product detail pages:
Creating a product detail page for a product already in the catalogue is prohibited.
Creating separate listings:
Sellers may not create separate listings for identical copies of the same item. Individually listing the same item several times is confusing for buyers and frustrating for other sellers. Sellers must use the quantity field to offer multiple copies of the same item, and only list separately if offering the same item in different conditions.
Pre-sells of BMVD Products:
Sellers should not list or match against Books, Music, Video or DVD products that we designates as pre-orderable. It is also important to maintain accurate inventory records, as instances of “stock-outs” could be reflected in your seller feedback rating. If an item you are offering will not be available for immediate shipping upon order, either cancel the order or alert the buyer, and initiate a refund if necessary. We will immediately cancel any seller listing for Books, Music, Video or DVD items that we designates as pre-orderable.
SECTION – 16 – SELLER SMS TEXT MESSAGE SERVICE TERMS
If you provide your mobile number to us, we may send you SMS messages related to your selling account.
The entity or person (you) who is using the SMS Text Message Service (the Service) assumes the financial responsibilities of the mobile phone account through which the Service is being accessed. We are not responsible for entities or individuals claiming that they did not authorise the use of their mobile phone for the Service.
Your mobile carrier’s standard messaging and data rates may apply to the text messages we send to you and the text messages you send to us. We does not charge you for receiving or sending text messages through the Service. We has no responsibility or liability in respect of any messaging fees, data charges or other charges charged by your mobile carrier for your use of the Service or for any other loss or damage which may be caused by your use of the Service.
We are not liable for any delays or failures in the receipt of any text messages sent to or from you in connection with the Service. Delivery depends on effective transmission by your mobile carrier. We provide the Service on an “as is” basis, without any representations or warranties, expressed or implied. Please continue to use Store Manager Dashboard as the primary means of managing your orders and seller account.
We can amend any of these Service Terms at any time and at our sole discretion. Any changes will be effective once posted on Store Manager Dashboard, and you are responsible for reviewing this location to stay up to date on all applicable changes.
SECTION – 17 – PROHIBITED CONTENT
Sellers are expected to conduct proper research to ensure that the items posted to our website are in compliance with all applicable laws. If we determine that the content of a product detail page or listing is prohibited, potentially illegal, or inappropriate, we may remove or alter it without prior notice. We reserves the right to make judgments about whether or not content is appropriate.
Any product listed in the Excluded Products list in the Seller Participation Agreement is prohibited for sale on the Aaksha.in site. Additionally, sellers are prohibited from listing the following products on Aaksha.in: Cell Phones including Service, Magazines and Newspapers, Tobacco and Alcohol, Adult Toys, Gift Cards and Gift Certificates, Prescription Medication, Guns and Ammunition, Photo Processing.
Counterfeit merchandise: Products offered for sale on Aaksha.in must be authentic. Any product that has been illegally replicated, reproduced or manufactured is prohibited.

Listing prohibited content may result in the cancellation of your listings, or the suspension or removal of your selling privileges. Sellers are responsible for ensuring that the products they offer are legal and authorised for sale or re-sale.
If we determine that the content of a product detail page or listing is prohibited, potentially illegal, or inappropriate, we may remove or alter it without prior notice. We reserves the right to make judgments about whether or not content is appropriate.
Prohibited Content
- Items not intended for distribution within India: Products that are specifically manufactured for, and identified as “not for distribution within India” cannot be sold on Aaksha.in. This includes the following; imported text books, non-Region 5 DVDs, and non-PAL format videotapes.
- Illegal and potentially illegal products: Products sold on Aaksha.in must adhere to all applicable laws. As sellers are legally liable for their actions and transactions, they must know the legal parameters surrounding any product they display on our website.
- Offensive material: We reserves the right to determine the appropriateness of listings posted to our website.
- Nudity: In general, images that portray nudity in a gratuitous or graphic manner are prohibited.
- Items that infringe upon an individual’s privacy. We holds personal privacy in the highest regard. Therefore, items that infringe upon, or have potential to infringe upon, an individual’s privacy are prohibited.
Intellectual Property Violations
- Counterfeit merchandise: Products displayed on our website must be authentic. Any product that has been illegally replicated, reproduced or manufactured is prohibited.
- Unauthorized and unlicensed merchandise: All items displayed on our Site must be commercially produced and authorized or licensed for sale as a retail product.
- Recopied media: Media products (books, movies, CDs, television programmes, software titles, videogames, and so on) that have been recopied, dubbed, duplicated, or transferred without permission of the rights holder are illegal to sell and are prohibited. This includes:
- Books – Unauthorised copies of books are prohibited.
- Music – Bootlegs, unauthorised live concerts, unauthorised soundboard recordings, unauthorised merchandise, etc., are prohibited.
- Movies – Unauthorised copies of movies in any format are prohibited. Unreleased/prereleased movies, screeners, trailers, unpublished and unauthorized film scripts (no ISBN number), electronic press kits, and unauthorised props are also prohibited.
- Photos – Unauthorised copies of photos are prohibited.
- Radio programs & Concerts – Unauthorised recordings or copies of recordings of radio programs are prohibited.
- Software – Recopied or duplicated software in any format is prohibited. Academic, OEM, back-up, fulfillment, promotional, beta (prerelease), unauthorised freeware/shareware, and “softlifted” versions of software are prohibited.
- Television programmes – Unauthorised copies of television programmes (including pay-per-view events), programmes never broadcast, unauthorised scripts, unauthorised props, and screeners are prohibited.
- Video games – Video games displayed on our website must be full retail versions. Recopied and transferred video games are prohibited. Mod chips, silver disks, video game emulators, Sega bootdisks, game enhancers, unauthorized video game compilations, unauthorized bundles of video game products, and unauthorized accessories are also prohibited.
- Transferred media. Media transferred from one format to another is prohibited. This includes but is not limited to: films converted from NTSC to Pal and Pal to NTSC, laserdisc to video, television to video, CD-ROM to cassette tape, from the Internet to any digital format, etc.
- Promotional media: Promotional versions of media products, including books (advance reading copies and uncorrected proofs), music, and videos (screeners) are prohibited. These products are distributed for promotional consideration and generally are not authorized for retail distribution or sale.
- Rights of Publicity: Celebrity images and/or the use of celebrity names cannot be used for commercial purposes without permission of a celebrity or their management. This includes product endorsements and use of a celebrity’s likeness on merchandise such as posters, mouse pads, clocks, image collections in digital format, and so on.
Prohibited Products (Media)
The following media items must not be listed for sale through the Marketplace programme:
- Promotional media: promotional versions of all media–including books (advance reading copies and uncorrected proofs), music, software, PC & video games, DVDs and videos (screeners)–are prohibited. These items are distributed for promotional consideration and are not authorised for retail distribution or sale.
- Unauthorised and unlicensed merchandise: all media–including books, CDs, VHS tapes, DVDs, software and PC & video games sold through Marketplace program–must be fully licensed and authorised versions. All items sold through the Marketplace program must be commercially produced and authorised or licensed as a retail product. Only full retail versions of software may be sold through Aaksha.in.
- Software: software that has been copied or duplicated in any format is prohibited. Additionally, academic, OEM, back-up, fulfillment, promotional, beta (prerelease), unauthorised freeware/shareware and “softlifted” software versions are prohibited. The majority of software licence agreements permit the initial licensee of the software to make a one-time permanent transfer of the licence directly to an end user. Sometimes the licence requires the transfer to include all of the software product (including all component parts, the media and printed materials, any upgrades, the licence itself and, if applicable, the Certificate of Authenticity). You should refer to your software’s licence agreement to ensure that any software posted for sale is permitted to be transferred.
- Video games: video games sold must be full retail versions. Recopied and transferred video games are prohibited. Mod chips, silver disks, video game emulators, Sega bootdisks, game enhancers, unauthorised video game compilations, and accessories are also prohibited.
- Region 1 DVDs: new region 1 DVDs are [restricted products] and may not be sold unless you have received pre-approval for such sales generally from Aaksha.in.
- Recopied media: copies, dubs, duplicates or transfers of books, music, videos, television programmes, radio programmes, concerts, DVDs, software etc., are prohibited. Recopied media infringe upon copyrights and trademarks and are illegal to sell. Just as you cannot sell a photocopied book without the author’s permission, you cannot sell copies or duplicates of videos, music, video games, software, photos or any copyrighted material without the permission of the copyright holder. The following list of prohibited products comprises two sections: General Prohibited Content and Intellectual Property Prohibited Content Violations. Listing products from the Prohibited products list can result in cancellation of listings, suspension from use of Aaksha.in tools and reports, or permanent suspension of selling privileges. Sellers are responsible for ensuring that the products they offer are legal and authorized for sale or re-sale.
- Cigarette substitutes: Electronic cigarettes and other nicotine-based products that are not approved as aids to smoking cessation by the relevant authority or agency.
- Electronic Surveillance Equipment: Any electronic surveillance equipments are prohibited from sale.
- Batteries: Mercuric oxide button batteries (button-shaped batteries used in vintage camera equipment), alkaline-manganese batteries containing mercury, and zinc-carbon batteries containing mercury are prohibited from sale.
- Mod chips: Mod chips or similar devices used to facilitate the use of copied or imported games etc are prohibited.
- Lock breaking devices: All devices used for lock picking, jamming, code reading, etc. are prohibited from sale. Lock picking guns, cards bypass keys and tryout keys are prohibited.
SECTION – 18 – RECALLS AND PRODUCT SAFETY
We want to ensure that products offered are safe and there is no risk that they will cause death, personal injury, or damage to property. Listings of any products that are recalled by the manufacturer or a government agency are prohibited. We also reserve the right to consider recalls made by government agencies of other countries.
Customers trust that they can always buy with confidence on Aaksha.in. Products that you offer for sale must comply with your Seller Agreement, including all applicable policies, and all applicable laws and regulations. This could increase your chances of succeeding as a seller on Aaksha.in, as well as help you to avoid practices that could lead to blocked listings, or even prevent you from selling on Aaksha.in.
Products that require additional approvals
Our policies require that certain products sold on Aaksha.in meet specified certification standards. Please ensure that you read all of the requirements and guidance before applying to sell these products. To sell these products on Aaksha.in, apply according to the instructions listed on the product page..
As a seller on Aaksha.in, you acknowledge and agree to comply with all applicable laws and regulations, and with policies.

- Informing the relevant governmental, legal and regulatory authorities for necessary action
We reserves the right to make judgments in its sole discretion about whether or not a listing is appropriate and whether the same is in contravention of policy.
Reporting
We encourages sellers to report product listings that violate policies or applicable laws at notice@aaksha.in. Include all relevant information, so we can conduct an investigation.

Product market withdrawals and recalls: overview
The following actions are in scope for product market withdrawals and recalls:
Product safety notification: Applicable for those incidents where no official withdrawal or recall has been initiated by the authorities or the manufacturer, but vendor is aware about a safety instruction that is relevant for customers. For example, a manufacturer publishes an instruction on their website to inform all customers that a ‘reset’ is required to guarantee safe use of their product.
Stop sale: This implies that certain products are permanently not allowed to be offered for sale in a particular store. This can be driven by safety, compliance or legal reasons. A stop sale implies that the product will be removed from sale and might not be eligible for future reinstatement.
Market withdrawal: This consists out of removing products from sale when retaining the option to future reinstatement. Products are subjected to market withdrawal because of a non-safety incident or a not significant safety incident.
Product recall: This implies that the product is posing an inherent safety risk for consumers and should be recalled from end users.

- The type of “recall” to be performed: public or private, market withdrawal, safety notice, or recall from end user
- The description of the hazard or issue with referring to relevant regulation, such as “The product poses a risk of choking because it contains small parts that may be easily detached and can be swallowed by small children”.
- The original recall notification or any relevant documents from the manufacturer or vendor, letter from government, customer feedback, etc.
- The list of barcodes, EANs impacted
- Any relevant information to identify the products affected (any pictures, the brand name, model numbers, serial numbers, batch numbers, expiry dates)
- The name, address and the contact number of the manufacturer
- The year and month of manufacture of the product or batch affected and recall duration, such as the affected products and the batch numbers (114278, 119646) that have been on sale since September 30, 2012.
- The scope (country or Europe-wide)
- Whether incoming Purchase Orders (POs) are impacted
- The confirmation of the availability of the product’s technical file to be shared with authorities if requested
- Instructions of disposal and proof of product disposal if required according to relevant regulations or government request
- Regardless of the type of “recall” (whether it is public or private), the formal notification must contain at least the following information unless others are defined in the relevant regulation or by government request and must be made within the legal period granted by the relevant authority:
- Brand, model, type or other distinguishing features that identifies the product
- Photograph or pictorial representation of the product where possible
- Actions or precautions to be taken
- Clear and understandable description of the problem/defect/hazard/issue requiring action.
- Name, address and other contact information of the manufacturer and distributor
- The addresses of the storage locations of affected products with product quantities, contact names and telephone numbers of the locations
- Recommended methods for avoiding hazard or effect or resolving problems
- Address of the locations for product returns or repairs
- Provide us with the proof of formal notifications made in compliant with the relevant regulation and request of the relevant authority, such as the proof of formal notification on manufacturer’s website, on two national TV channels, and newspapers in Turkey. Also, provide the proof of all relevant documents having been transmitted to the relevant authority.
- In case of a recall from end users, the instructions for the consumer to follow, where possible a remedy for all affected customers, vendor or manufacturer contact details, such as telephone number and e-mail address to handle any consumer inquiries. For example, if you have used one of the products with a batch number indicated, then please do not use your equipment and contact our manufacturer on the phone number below for advice and information.

SECTION – 19 – CATEGORY, PRODUCT AND LISTING RESTRICTIONS
Certain products cannot be listed or sold on Aaksha.in. Some products may not be listed as a matter of compliance with legal or regulatory restrictions (for example, prescription drugs) or in accordance with policy (for example, crime scene photos). For detailed information, please see our Excluded Products list below.
Policies also prohibit specific types of product content. For guidelines on prohibited content and copyright violations, please see our Prohibited Content List below.
For some product categories, sellers may not create product listings without prior approval from Aaksha.in.
Excluded Products List
“Excluded Products” include products that are prohibited from being listed on the Site, such as the following:
- Alcohol
- Automotive and powersports
- Banned books, pamphlets, booklets, periodicals, films
- Used clothing and shoes
- Currency, coins and cash equivalents
- Postage meters and stamps
- Jewellery and precious gems, including loose gemstone products
- Gift cards (except retail gift cards for which authorisation from the RBI has been obtained), gift vouchers and other stored value instruments
- Cosmetics and skin or hair care products such as these
- All jammers, Cell phone / Mobile phone signal boosters, extenders, repeaters or amplifiers, Wi-Fi long distance signal boosters
- Electronics such as these
- Fine art such as these
- Gambling & lottery products
- Hazardous and dangerous items
- Offensive Products
- Plastic and thermocol products such as these
- Recalled products or products subject to a regulatory safety alert
- Stolen property & lock picking devices
- Surveillance equipment
- Products that are identified as acids and all preparations and admixtures of acids
- Food products with incorrect claims of USDA certification
- Food products and supplements such as these
- Products sold as or for the purpose of car seat belt alarm stoppers, car seat belt alarm cancellers, seat belt buckle alarm canceller
- Tobacco & Tobacco-Related Products, including cigars, cigarettes, tobacco or other products containing tobacco
- Fertilisers that fall under the scope of Nutrient Based (NBS) fertiliser
- Fireworks and other pyrotechnics
- Cylinder and cylinder liquified petroleum gas or LPG transfer nozzle, gas refill adapter with moveable rod inside tube, gas refill nozzle and LPG cylinder gas re-filler adapter nozzle
- Weapons
- Drugs and drug paraphernalia
- Sale of caffeine powder, bulk caffeine powder and pure caffeine powder. When a product is marketed as caffeine powder, but the concentration or purity of the caffeine cannot be determined, such items shall be prohibited. We allows the sale of supplements and related products that contain caffeine as an ingredient and also the sale of liquid or tablet caffeine products
- Hemp seeds and food products prepared from hemp seeds that do not comply with the FSSAI standards
- Human parts and burial artefacts, including products containing human growth hormone and elements of the human body, and medical implants
- Animals and animal products, including products made of or containing any or part of any plant or animal, for which the sale, storage, import or export is prohibited or regulated. For example, endangered species, elephant ivory, coral, sea turtle shells and most reptile skins
- Glue traps used for trapping birds or animals
- Distorted India map
- Washington Redskins merchandise
- Padded Crib Bumpers (PCBs) and similar accessories, including vertical crib slat covers and top rail covers
- Embargoed goods
- Products that are identified as “not for distribution within India”
- Products that infringe upon an individual’s privacy, such as display of marketing lists and personal information
- Real property or real estate
- Government documents, identification, birth certificates, passports and licences, or sale of any documents relating to mass transportation, rail, air and so on
- Government and transit uniforms, security uniforms, transport uniforms, commercial uniforms, IDs and licences, police and other security forces’ badges and uniforms
- Identification cards that look similar to identification cards issued by the Government of India, such as Aadhaar Cards, Driving licences, Passports, Vehicle Registration Cards, Voter ID Cards, PAN Cards, Ration Cards
- Domain names
- Products intended to be used to produce an illegal product or undertake an illegal activity
- Database lists of names, addresses, e-mail addresses, personal information and mailings lists of any kind
- Plants, such as the following:
- Plants or seeds designated by the Indian government as “noxious”
- Illegal plants or seeds
- Restricted plants, such as the following:
- Red Vanda (Botanical Name: Rananthera Imschootiana)
- Blue Vanda (Botanical Name: Vanda Coerulea)
- Pitcher plants (Botanical Name: Nepenthes Khasiana)
- Kuth/Kushta (Botanical Name: Saussurea Costus/Saussurea Lappa)
- Beddomes Cycad (Botanical Name: Cycas Beddomei)
- Lady’s slipper orchids (Botanical Name: Paphiopedilum)
- Products with any pictorial representation or colourable imitation of the “Indian National Flag” printed on them that constitute gross disrespect to the Indian National Flag
- Products with pictorial representation or colourable imitation of emblem, seal, flag, insignia, coat-of arms, such as State emblem, insignias like Balidan Badge
- Products with the name or pictorial representation of eminent Indian personalities such as the following:
- The Prime Minister of India
- The President of India
- Pandit Jawaharlal Nehru (Nehru)
- Mahatma Gandhi (Gandhi)
- Shrimati Indira Gandhi
- Shri Lal Bahadur Shastri (Lal Bahadur Shastri)
- Chhatrapati Shivaji Maharaj
- Rashtrapati Bhavan (Raj Bhavan)
- Products which are restricted from being listed and sold within certain regions in India, such as:
- Sky lanterns (Gujarat)
- Areca nuts (Maharashtra)
- Drones (Delhi NCR & Srinagar)
- Halal labelled/certified food products, drugs and cosmetics (Uttar Pradesh)
- Bottled correcting fluids and bottled thinners (Chandigarh)
- Sex and sensuality products
- Products containing prohibited images of children and any other violent, offensive, obscene or sexual content that is unlawful
- DVDs other than region 2, region 0 or region All and Blu-ray discs other than region B or region free
- Products that cannot be lawfully shipped to or sold in India
- Any product that is subject to a product recall
- Products that infringe another party’s Intellectual Property Rights
- Any product that contains other ingredients that are prohibited, restricted or regulated under applicable law
- Any other types of products that, at our discretion, are not supported for sale through the Services (including any prohibited items listed in the “Policies and Agreements” section of Seller Central or your account respectively), provided that an Excluded Product will cease to be an Excluded Product when we inform you so
Restricted Products
Restricted Products may be listed and sold on Site only after fulfilment of certain compliance parameters. Examples of Restricted Product listings which may be sold subject to fulfilment of conditions are as follows:
- Homeopathic products
- Large furniture
- Medical devices and accessories
- Over The Counter drugs (OTC drugs)
- Sale of large appliances
- School Bundles
- Television sets
- Fertilisers
- Entertainment Collectibles
- Collectible coins and paper money
- Fine Art

Consequences for Violations
Listing of products in violation of policies or violation of applicable laws and regulations may result in actions, such as:
- Cancellation of listing
- Limits on listing privileges
- Suspension of listing privileges
- Removal of your listing privileges
- Termination of your agreement and such other arrangement; or
- Informing the relevant governmental, legal and regulatory authorities for necessary action
We reserves the right to make judgments in its sole discretion about whether or not a listing is appropriate and whether the same is in contravention of policy.
Prohibited Content
- Items not intended for distribution within India: Products that are specifically manufactured for, and identified as “not for distribution within India” cannot be sold on Aaksha.in. This includes the following; imported text books, non-Region 5 DVDs, and non-PAL format videotapes.
- Illegal and potentially illegal products: Products sold on Aaksha.in must adhere to all applicable laws. As sellers are legally liable for their actions and transactions, they must know the legal parameters surrounding any product they display on our website.
- Offensive material: We reserves the right to determine the appropriateness of listings posted to our website.
- Nudity: In general, images that portray nudity in a gratuitous or graphic manner are prohibited.
- Items that infringe upon an individual’s privacy. We holds personal privacy in the highest regard. Therefore, items that infringe upon, or have potential to infringe upon, an individual’s privacy are prohibited.
Intellectual Property Violations
- Counterfeit merchandise: Products displayed on our website must be authentic. Any product that has been illegally replicated, reproduced or manufactured is prohibited.
- Unauthorized and unlicensed merchandise: All items displayed on our Site must be commercially produced and authorized or licensed for sale as a retail product.
- Recopied media: Media products (books, movies, CDs, television programmes, software titles, videogames, and so on) that have been recopied, dubbed, duplicated, or transferred without permission of the rights holder are illegal to sell and are prohibited. This includes:
- Books – Unauthorised copies of books are prohibited.
- Music – Bootlegs, unauthorised live concerts, unauthorised soundboard recordings, unauthorised merchandise, etc., are prohibited.
- Movies – Unauthorised copies of movies in any format are prohibited. Unreleased/prereleased movies, screeners, trailers, unpublished and unauthorized film scripts (no ISBN number), electronic press kits, and unauthorised props are also prohibited.
- Photos – Unauthorised copies of photos are prohibited.
- Radio programs & Concerts – Unauthorised recordings or copies of recordings of radio programs are prohibited.
- Software – Recopied or duplicated software in any format is prohibited. Academic, OEM, back-up, fulfillment, promotional, beta (prerelease), unauthorised freeware/shareware, and “softlifted” versions of software are prohibited.
- Television programmes – Unauthorised copies of television programmes (including pay-per-view events), programmes never broadcast, unauthorised scripts, unauthorised props, and screeners are prohibited.
- Video games – Video games displayed on our website must be full retail versions. Recopied and transferred video games are prohibited. Mod chips, silver disks, video game emulators, Sega bootdisks, game enhancers, unauthorized video game compilations, unauthorized bundles of video game products, and unauthorized accessories are also prohibited.
- Transferred media. Media transferred from one format to another is prohibited. This includes but is not limited to: films converted from NTSC to Pal and Pal to NTSC, laserdisc to video, television to video, CD-ROM to cassette tape, from the Internet to any digital format, etc.
- Promotional media: Promotional versions of media products, including books (advance reading copies and uncorrected proofs), music, and videos (screeners) are prohibited. These products are distributed for promotional consideration and generally are not authorized for retail distribution or sale.
- Rights of Publicity: Celebrity images and/or the use of celebrity names cannot be used for commercial purposes without permission of a celebrity or their management. This includes product endorsements and use of a celebrity’s likeness on merchandise such as posters, mouse pads, clocks, image collections in digital format, and so on.
Prohibited Products (Media)
The following media items must not be listed for sale through the Aaksha.in Marketplace programme:
- Promotional media: promotional versions of all media–including books (advance reading copies and uncorrected proofs), music, software, PC & video games, DVDs and videos (screeners)–are prohibited. These items are distributed for promotional consideration and are not authorised for retail distribution or sale.
- Unauthorised and unlicensed merchandise: all media–including books, CDs, VHS tapes, DVDs, software and PC & video games sold through Marketplace program–must be fully licensed and authorised versions. All items sold through the Marketplace program must be commercially produced and authorised or licensed as a retail product. Only full retail versions of software may be sold through Aaksha.in.
- Software: software that has been copied or duplicated in any format is prohibited. Additionally, academic, OEM, back-up, fulfillment, promotional, beta (prerelease), unauthorised freeware/shareware and “softlifted” software versions are prohibited. The majority of software licence agreements permit the initial licensee of the software to make a one-time permanent transfer of the licence directly to an end user. Sometimes the licence requires the transfer to include all of the software product (including all component parts, the media and printed materials, any upgrades, the licence itself and, if applicable, the Certificate of Authenticity). You should refer to your software’s licence agreement to ensure that any software posted for sale is permitted to be transferred.
- Video games: video games sold through Aaksha.in must be full retail versions. Recopied and transferred video games are prohibited. Mod chips, silver disks, video game emulators, Sega bootdisks, game enhancers, unauthorised video game compilations, and accessories are also prohibited.
- Region 1 DVDs: new region 1 DVDs are [restricted products] and may not be sold unless you have received pre-approval for such sales generally from Aaksha.in.
- Recopied media: copies, dubs, duplicates or transfers of books, music, videos, television programmes, radio programmes, concerts, DVDs, software etc., are prohibited. Recopied media infringe upon copyrights and trademarks and are illegal to sell. Just as you cannot sell a photocopied book without the author’s permission, you cannot sell copies or duplicates of videos, music, video games, software, photos or any copyrighted material without the permission of the copyright holder. The following list of prohibited products comprises two sections: General Prohibited Content and Intellectual Property Prohibited Content Violations. Listing products from the Prohibited products list can result in cancellation of listings, suspension from use of Aaksha.in tools and reports, or permanent suspension of selling privileges. Sellers are responsible for ensuring that the products they offer are legal and authorized for sale or re-sale.
- Cigarette substitutes: Electronic cigarettes and other nicotine-based products that are not approved as aids to smoking cessation by the relevant authority or agency.
- Electronic Surveillance Equipment: Any electronic surveillance equipments are prohibited from sale.
- Batteries: Mercuric oxide button batteries (button-shaped batteries used in vintage camera equipment), alkaline-manganese batteries containing mercury, and zinc-carbon batteries containing mercury are prohibited from sale.
- Mod chips: Mod chips or similar devices used to facilitate the use of copied or imported games etc are prohibited.
- Lock breaking devices: All devices used for lock picking, jamming, code reading, etc. are prohibited from sale. Lock picking guns, cards bypass keys and tryout keys are prohibited.
SECTION – 20 – PRODUCT LISTING APPROVAL PROCESS
Grocery & gourmet foods
For certain high sensitive categories like food, UASPL has a high bar for sellers to list products on Aaksha.in. In order to ensure that our customers are able to buy food products with confidence on Aaksha.in, we have implemented additional compliance checks for sellers. The requirements for selling in the Grocery & Gourmet Food category reflect customer concerns about product quality, product branding and consumer safety.
Sellers must meet the requirements listed below to sell products in the Grocery & Gourmet Food category. In order to sell Grocery & Gourmet Food, you must submit the following:
Mandatory requirements: All the requirements/documents listed in serial no. 1 to serial no. 5 are mandatory for every food product/product type.
- FSSAI Licence, in compliance with below requirements:
- FSSAI Licence should be in your name or your company name.
- FSSAI Licence should be valid for more than 2 months at the time of requesting approval.
- The ‘scope’ of the licence should include all food products or food product categories that you intend to list on Aaksha.in. In case of “Proprietary Foods”, the term ‘Proprietary Food’ should be specified against the food product category/sub-category.
- Display your FSSAI Licence Number on your storefront.
- As per FSSAI regulations it is mandatory for a seller to display FSSAI Licence number on an e-commerce store.
- List of products that you are applying to sell, their shelf life, storage temperature, if products are organic, fortified, vegan, Ayurveda aahara.
- Food Declaration as per template.
- All side images of the products in accordance to the guidelines mentioned in Imaging Guideline for Food ASINs help page and FSSAI requirements. The listing shall be in accordance to the grocery style guide
- Valid Purchase Invoice [Resellers only].

1Temperature sensitive food products, fresh eggs, and fresh fruits and vegetables
Listing and sale of “Temperature sensitive food products”, “Fresh eggs” and “Fresh fruits and vegetables” are through an invite-only model at this point. Invited sellers are allowed to list “Temperature sensitive food products” only after physical verification of necessary licences, documents or QC processes in accordance with the following guidance:

Sellers are responsible for setting their own prices and play an important role in providing our customers with the largest selection, at competitive prices along with fast delivery.
To ensure that sellers do not face pricing errors and the same are removed from the marketplace, We regularly monitors the prices of items, including the shipping charges. We compares prices added by sellers with past selling prices and other prices available on the marketplace to filter and remove erroneous prices. If we finds seller pricing instances/practices that harm customer trust, we may remove the Buy Box, remove the offer, or in serious or repeated cases, suspend or terminate selling privileges of the seller.
Pricing practices of the seller that harm customer trust include, but are not limited to:
- Setting a reference price on a product or service that cannot be ordinarily commercially justified, and may mislead customers
- Setting a price on a product or service that is significantly higher than recent prices offered on Aaksha.in
Reiterating, while sellers are free to price their products as per their business strategy, to protect customer interests, we might remove egregious prices or restrict their visibility on the marketplace.
